Acceptance of Terms

By accessing or using the CryptoBitPesa platform ("Platform", "Service") at cryptobitpesa.com, creating an account, or making any transaction, you ("User", "you") agree to be legally bound by these Terms of Service ("Terms").

If you do not agree to these Terms, you must not use the Platform. These Terms constitute a binding legal agreement between you and CryptoBitPesa.

Eligibility

To use CryptoBitPesa, you must:

• Be at least 18 years of age.
• Be a resident of Kenya or a jurisdiction where our services are not prohibited.
• Have the legal capacity to enter into a binding contract.
• Not be prohibited from using financial services under any applicable law.
• Provide accurate, current, and complete information during registration.

By registering, you represent and warrant that you meet all eligibility requirements.

Account Registration & KYC

You must register an account to access our services. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

We require all users to complete Know Your Customer (KYC) verification before making deposits or withdrawals above regulatory thresholds. KYC requires submission of:

• A valid Kenya National Identity Card (or Passport for non-citizens).
• A selfie or clear photograph for identity verification.
• Additional documentation as may be required under our AML Policy.

You must not create multiple accounts. Duplicate accounts will be suspended without notice.

Services Offered

CryptoBitPesa provides the following services:

• Cryptocurrency copy trading and investment plans with stated return rates.
• M-Pesa deposit and withdrawal processing.
• Portfolio tracking and transaction history.
• Peer-to-peer money transfer between registered users.
• A referral programme for earning commissions.

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice where possible.

Deposits & Withdrawals

Minimum deposit: USD 50 (or equivalent in KES at the prevailing rate).

Deposits are processed via M-Pesa STK Push. Once a deposit is confirmed by M-Pesa, it will be credited to your account balance. We are not responsible for delays caused by Safaricom or M-Pesa network issues.

Withdrawals are subject to:

• Completed KYC verification on your account.
• Sufficient available balance (not locked in active investment plans).
• Our processing schedule — withdrawals are typically processed within 24–72 hours on business days.
• Any applicable withdrawal fees as stated on the Platform.

Investment Plans & Returns

CryptoBitPesa offers investment plans with stated return rates. By investing in a plan, you acknowledge and agree that:

• Stated returns are projections based on trading performance and are not guaranteed.
• Past performance does not guarantee future results.
• Cryptocurrency markets are highly volatile and investments may decrease in value.
• You may lose some or all of your invested capital.
• Returns are credited to your account balance subject to plan terms and conditions.
• Invested funds are locked for the duration of the plan and cannot be withdrawn early.

Referral Programme

CryptoBitPesa operates a referral programme that allows users to earn commissions when they refer new users who make qualifying deposits.

• Referral commissions are credited automatically when a referred user's deposit is approved.
• Commissions are based on rates stated on the Platform and may change with notice.
• Self-referrals and fraudulent referrals are strictly prohibited and will result in account termination and forfeiture of all commissions.
• Referral commissions are subject to the same withdrawal terms as account balances.

Fees & Charges

CryptoBitPesa may charge fees for certain services. All applicable fees are displayed on the Platform before you confirm a transaction. We reserve the right to introduce or modify fees with 7 days' notice to registered users.

M-Pesa transaction charges imposed by Safaricom are separate from our fees and are the user's responsibility.

Prohibited Activities

You must not use the Platform to:

• Engage in money laundering, terrorist financing, or any illegal financial activity.
• Create fake or duplicate accounts.
• Use automated bots, scripts, or systems to interact with the Platform.
• Attempt to hack, disrupt, or gain unauthorised access to the Platform or other users' accounts.
• Provide false or misleading information during registration or KYC.
• Engage in fraudulent referral activities.
• Violate any applicable Kenyan law or regulation.

Violation of these prohibitions may result in immediate account suspension, termination, and reporting to relevant authorities.

Suspension & Termination

We reserve the right to suspend or terminate your account at any time if:

• You violate these Terms.
• We suspect fraudulent, illegal, or suspicious activity.
• You fail to complete KYC verification within the required timeframe.
• We are required to do so by a regulatory authority or court order.

Upon termination, any available balance (excluding locked investments) will be returned to you after deducting applicable fees, subject to the completion of any pending investigations.

Limitation of Liability

To the maximum extent permitted by Kenyan law, CryptoBitPesa shall not be liable for:

• Investment losses resulting from market volatility or adverse trading conditions.
• Losses caused by M-Pesa network failures, Safaricom downtime, or payment processing errors beyond our control.
• Indirect, consequential, or incidental damages arising from use of the Platform.
• Unauthorised access to your account resulting from your failure to protect your credentials.
• Force majeure events including acts of God, government actions, or infrastructure failures.

Our total liability to you in any circumstances shall not exceed the total amount deposited by you in the 90 days preceding the event giving rise to the claim.

Intellectual Property

All content on the Platform including the CryptoBitPesa name, logo, design, text, and software is owned by or licensed to CryptoBitPesa and is protected by Kenyan and international intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

Dispute Resolution

In the event of a dispute, you agree to first contact our support team at support@cryptobitpesa.com to seek an informal resolution. We will respond within 7 business days.

If a dispute cannot be resolved informally, it shall be referred to mediation or arbitration in Nairobi, Kenya, in accordance with Kenyan law.

Governing Law

These Terms are governed by and construed in accordance with the laws of Kenya. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Kenya.

Changes to Terms

We may update these Terms at any time. Material changes will be communicated to registered users by email or platform notification at least 7 days before taking effect. Continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.
